Following the 85/374/CEE directive in matter of responsibility for damage due to defective products, the responsibility of the manufacturer is only implied, if the product was defective from the origin and is otherwise attenuated, if not abrogated, if the user did not adhere to the instructions of use and to the product-standards. The machinery directive imposes severe rules to the constructor, but at the same time it obligates the user, to assure at the moment of the purchase that the product is in compliance with the directive.
